Video Aegis Digital Millennium Copyright Act (DMCA) Policy

Video Aegis Inc. (“Video Aegis”) respects the intellectual property rights of others and expects its users to do the same. This policy outlines the procedures for reporting alleged copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).


1. Designated Copyright Agent

Pursuant to 17 U.S.C. § 512(c), Video Aegis has designated a Copyright Agent to receive notifications of alleged infringement.

2. Infringement Notification (DMCA Takedown Notice)

To be effective, a notification of claimed infringement (a "Takedown Notice") must be a written communication provided to the Designated Agent and must substantially include the following elements:

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material (e.g., specific URLs where the content can be found).
  4. Contact Information: Information reasonably sufficient to permit Video Aegis to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
  5. Good Faith Belief Statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  7. Failure to include all of the above information may result in the delay or failure to process your Takedown Notice.


3. Video Aegis's Response to Takedown Notices

Upon receipt of a valid Takedown Notice, Video Aegis will promptly:

  1. Remove or disable access to the material identified as infringing.
  2. Take reasonable steps to notify the party that provided the allegedly infringing content (the "User") that the material has been removed or access has been disabled.


4. Counter-Notification Procedure

The User whose material was removed or disabled may submit a counter-notification to the Designated Agent if they believe the material was removed or disabled as a result of mistake or misidentification. To be effective, the counter-notification must be a written communication provided to the Designated Agent and must substantially include the following:

  1. Physical or Electronic Signature: The physical or electronic signature of the User.
  2. Identification of Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  3. Statement Under Penalty of Perjury: A statement, under penalty of perjury, that the User has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Consent to Jurisdiction: The User's name, address, and telephone number, and a statement that the User consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the User’s address is outside of the United States, for any judicial district in which Video Aegis may be found, and that the User will accept service of process from the person who provided the original Takedown Notice or an agent of such person.

Upon receipt of a valid counter-notification, Video Aegis may forward a copy to the original complaining party, informing them that Video Aegis may replace the removed material or cease disabling access to it in ten (10) business days.


5. Repeat Infringer Policy

Video Aegis will terminate the accounts of users who are determined by Video Aegis, in its sole discretion, to be repeat infringers of copyrighted works.
